EP155 停車位真的「是你的」嗎？ 社區大樓附的編號法定停車位，對這個車位有單獨所有權嗎？阿明三年前買了房子，附一個標示「B12」的停車位。他以為那就是他的車位，後來也白紙黑字賣給了鄰居。 結果幾年後賣房時，才發現——那格車位在權狀上其實還是自己的！ 怎麼會這樣？ 1. 多數社區的法定停車位是「共有部分」，也就是大家共同持有。 2. 你擁有的是「持分」＋「使用權」，不是完整產權。 3. 要轉讓車位，必須經過地政機關登記、調整持分，否則法律上不承認產權移轉。 4. 車位只能轉讓給同一棟大樓的住戶，不能賣給外人！ 如果你家車位也有編號，不妨翻翻權狀，看看它是「共有部分」還是「專有產權」？了解清楚，才能避免未來糾紛。 -- Hosting provided by <a href="https://www.soundon.fm/">SoundOn</a>

EP 154：房屋買賣仲介費：何時該付？ 買賣契約成立時，支付仲介費是常識。但若交易未成交，或非透過該仲介成交，是否仍需支付？ 買賣雙方與仲介簽訂「居間契約」。分為「報告居間」（僅提供資訊）與「締約居間」（積極促成交易）。而一般仲介多屬「締約居間」，依據內政部規範仲介收取報酬不超過成交價額6%，業界支付慣例為買方2%、賣方4%。 未成交情況下的收費爭議： -提前終止委託或屆期後之「後成交」條款：約滿後於特定期間內，與仲介曾介紹的對象成交，仍須支付。旨在防止買賣雙方有意規避仲介費。 -已買方接受賣方開出價格，但賣方反悔而不簽約：因買賣雙方已達成價格共識，契約已成立。即便單方反悔者，仲介仍有權請求服務費。 -簽約後，雙方合意解除契約：契約成立後，雙方合意解除，仲介仍可主張收費。 -無法順利核貸：若是出於大環境因素（如房貸政策），在不可歸責雙方時，有些房仲會不收費服務費，有些依舊會收取部分報酬。但若出於買方個人信用問題所致，是屬於違約事由，仲介會從沒收定金中收取部分報酬。 小結： 簽約前務必釐清契約內容，如一般委託或專任委託；服務費收取比例與違約責任。了解清楚合約內容，能保障自身權益，避免爭議。 -- Hosting provided by <a href="https://www.soundon.fm/">SoundOn</a>

EP153｜把別人的東西弄壞了，要賠多少？ 當一個人的行為造成他人財物損害，依法必須負擔損害賠償責任。除非法律另有規定，或雙方有特別約定，原則上應「回復原狀」──也就是讓受害人恢復至假設未發生損害時應有的狀況，而非僅止於回到受損前的狀態。 損害是否可修復，影響後續處理方式： 1. 損害可修復時： 若損害可透過修理恢復功能，加害人可自行或委託他人修理；為避免拖延，受害人也可以自行修理，再向加害人請求必要費用。 若因更換新品而產生額外利益，則須考量是否扣除折舊。實務上會參考：行政院公布的「固定資產耐用年數表」、「固定資產折舊率表」及「營利事業所得稅查核準則」。常見折舊方式有兩種：1.平均法（直線折舊）：每年折舊金額固定。2.定率遞減法（加速折舊）：前期折舊較多、後期較少。修復費用中，「工資」通常不折舊，但「材料費」可能須折舊。過去實務認為只要新換舊就應折舊，但現在會進一步評估受害人是否真正獲得利益，例如更換後是否延長使用年限，若無實質利益，則不計折舊。 此外，即便物品修復完好，若因成為「事故品」導致市場價值減損，受害人仍可請求賠償價值減少的損失。 2. 損害無法修復或修復顯有困難時： 若為古董、名畫、電腦主機板等無法修復，或修復費用遠高於原物價值的情況，則改採「金錢賠償」。賠償金額以「購買同等物品的費用」（包含交換價值與使用價值）為準，而非修復費。 小結： 損害賠償的核心是「回復原狀」，而非讓人獲得全新品，這是為了填補損失、避免不當得利。是否扣除折舊，須視受害人是否因此「得利」；若無法修復，則改以購買同等物品為賠償依據。 -- Hosting provided by <a href="https://www.soundon.fm/">SoundOn</a>
